Terms of Service

1. Acceptance of Terms

By accessing or using TagNYC (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use this Service. By using TagNYC, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have obtained parental or guardian consent.

3. User-Generated Content

TagNYC allows users to create and publish virtual graffiti ("tags") on 3D representations of real New York City buildings. You are solely responsible for the content you create and publish.

Prohibited content includes but is not limited to:

• Hate symbols, slurs, or content promoting discrimination based on race, ethnicity, religion, gender, sexual orientation, or disability
• Sexual content, especially involving minors
• Doxxing (sharing personal information of private individuals without consent)
• Credible threats of violence
• Content that infringes on trademarks or copyrights
• Spam or mass-duplicated content
• Content that encourages or depicts real-world vandalism

TagNYC reserves the right to remove any content at any time, with or without cause, and to ban users who violate these policies.

4. Content Moderation

TagNYC employs automated screening and human review of user-generated content. Tags may be removed automatically or manually. Users can report content for review. Repeated violations result in permanent account suspension.

Tags are automatically reviewed before publication. Some content may be held for manual review before becoming publicly visible.

5. Virtual Only

TagNYC is a virtual platform. Tags exist only in the digital representation of buildings. TagNYC does not encourage, endorse, or promote real-world vandalism or graffiti on physical property. The tagline "The only city where graffiti is legal everywhere" refers solely to virtual graffiti within this platform.

6. Intellectual Property

You retain ownership of your original tag artwork. By publishing a tag, you grant TagNYC a non-exclusive, royalty-free license to display, reproduce, and distribute your tag within the Service.

Building data is derived from NYC Open Data, which is free for public use. Building geometry is publicly available information.

7. DMCA / Copyright Takedown

To file a DMCA takedown notice for content you believe infringes your copyright, send a written notice to: abuse@tagnyc.co with the following:

• Identification of the copyrighted work
• Identification of the allegedly infringing content (tag ID or URL)
• Your contact information
• A statement that you have a good faith belief that the use is not authorized
• A statement under penalty of perjury that the information is accurate and you are the owner or authorized to act
• Your physical or electronic signature

8. Abuse Contact

To report abuse, harassment, or prohibited content, contact abuse@tagnyc.co or use the in-app report button on any tag.

9. Disclaimers

The Service is provided "as is" without warranty of any kind. Building data may be incomplete or outdated. TagNYC is not responsible for the accuracy of building representations.

10. Limitation of Liability

TagNYC and its operators shall not be liable for any indirect, incidental, or consequential damages arising from use of the Service.

11. Changes to Terms

We may update these Terms at any time. Continued use after changes constitutes acceptance of the updated Terms.
